Membership Terms

Payment Terms - Distinct Fees
Late fee: $15 may be assessed when membership dues are not received by the applicable due date. BFIT may waive this late fee at its discretion based on individual circumstances; a waiver does not establish a future waiver. Returned bank draft (NSF) fee: A separate $10 processing fee applies to a bank draft returned for insufficient funds, where permitted by law. BFIT does not ordinarily waive or refund this fee, except where required by law or to correct an error. The NSF fee is separate from the late fee and any properly disclosed card processing charge. The two fees may both apply only when their independent conditions are met and their combined application is lawful. Failed payment does not itself cancel membership. Recurring electronic payments require a separate compliant authorization.
Nonpayment, Access & Reinstatement
After three consecutive months of unsuccessful payments, BFIT may suspend access, stop further automatic draft attempts, and classify the account as NP (Non-Payer - Settlement Required), subject to notice, applicable law, and the agreement. NP is an administrative status, not automatic cancellation or debt forgiveness. Management determines cancellation and any lawful balance due. Reactivation requires management approval and resolution of valid outstanding charges or an approved written settlement. No additional reconnect fee or probation surcharge is imposed by this draft.
Online Registration, Minors & Facility Rules
Independent online signup is limited to adults 18 or older. Minors must complete a BFIT-approved parent/legal guardian consent and signature process. Applicants must provide accurate information. BFIT may review online registrations the next business day and request identity verification. Follow posted safety rules; do not share access or permit unauthorized entry.
Risk Acknowledgment & Legal Notices
Exercise and equipment use carry risks of injury and medical emergencies. Members agree to follow facility rules and use equipment responsibly. The existing BFIT agreement includes a PAR-Q reference and a broad release, waiver, and indemnity clause. Counsel-approved waiver wording must be inserted or incorporated as an attachment before use. TEXAS HEALTH SPA ACT: This agreement is subject to Texas Occupations Code Chapter 702, including applicable cancellation and refund rights. The original contract includes purchaser rights and notices for cancellation, closure/relocation, death/disability, and prepaid dues; these must be replaced or supplemented with the current legally required text before execution. Statutory rights control over conflicting terms.
